These Terms of Service ("Terms") govern Your access to and use of the YourNextHome platform (the "Service"). Please read them carefully.
YourNextHome is a business-to-business service intended for companies and professionals. By creating an account, subscribing, or otherwise using the Service, You agree to be bound by these Terms on behalf of the organization You represent. If You do not agree, do not use the Service.
Who We Are
The Service is operated by The Digital Bunch Sp. z o.o., Hoża 51, 00-681 Warsaw, Poland, registered in the National Court Register under KRS 0000919623, NIP 1133040074, REGON 389863478 ("We", "Us", "Our"). Our full registration details are available on Our Company Details page.
Definitions
- Service means the YourNextHome platform, including the website, the customer dashboard, and the interactive property viewer.
- Account means the account You create to access the Service.
- Project means an individual property showcase (an estate) that You create and may publish through the Service.
- Customer Content means any data, images, media, and other materials You upload to or create within the Service.
- Subscription means a paid plan that makes a Project publicly available.
The Service
The Service lets You build and host interactive property showcases and publish them for public access on a per-Project basis. We may update, improve, or change features of the Service over time. We may also add, modify, or discontinue parts of the Service, and will give reasonable notice of material changes where practical.
Accounts
You are responsible for the accuracy of the information You provide, for keeping Your login credentials confidential, and for all activity that occurs under Your Account. You must notify Us promptly of any unauthorized use. You must be authorized to act on behalf of the organization for which You register.
Subscriptions and Billing
Publishing a Project requires an active Subscription for that Project. Subscriptions are billed per Project on the cadence You select at checkout — either monthly ($400 per month) or yearly ($4,000 per year). Prices are exclusive of any applicable taxes unless stated otherwise.
Payments are processed by Stripe. By subscribing You authorize Us, through Stripe, to charge Your chosen payment method for the applicable fees. We do not store Your full card details.
Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel a Project's Subscription at any time from Your dashboard. When You cancel, the Project remains published until the end of the period You have already paid for, after which it stops being publicly available.
Refunds
Payments are non-refundable. We do not provide refunds or credits for partial billing periods, unused time, or Projects that remain published but unused. This does not affect any rights You may have that cannot be excluded under applicable law.
Your Content and Responsibilities
You retain all rights to Your Customer Content. You grant Us a limited licence to host, process, display, and deliver that content solely as needed to operate and provide the Service, including publishing it as part of a published Project.
You are solely responsible for Your Customer Content and represent that You own it or have all rights and permissions needed to use it, and that it does not infringe any third party's rights or violate any law.
Acceptable Use
You agree not to:
- Use the Service for any unlawful, misleading, or fraudulent purpose.
- Upload content that is illegal, infringing, defamatory, or that You do not have the right to use.
- Attempt to gain unauthorized access to the Service, other accounts, or Our systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer, resell, or sublicense the Service except as expressly permitted.
Intellectual Property
The Service, including its software, design, and underlying technology, is and remains Our property or that of Our licensors. These Terms do not grant You any right in the Service other than the limited right to use it in accordance with these Terms. Customer Content remains Yours.
Third-Party Services
The Service relies on third-party providers (for example, payment, hosting, and analytics providers) to function. Your use of the Service may be subject to those providers' terms, and We are not responsible for their acts or omissions. How We handle Personal Data, and which providers We use, is described in Our Privacy Policy.
Custom Domains
If You connect Your own domain to a Project, You are responsible for holding the necessary rights to that domain and for maintaining its registration. Connecting a domain requires an active Subscription; if the Subscription lapses, the Project stops being served from that domain.
Availability and Support
We aim to keep the Service available and reliable, but We provide it on a best-effort basis and do not guarantee uninterrupted or error-free operation. Support is available at support@yournexthome.app.
Suspension and Termination
We may suspend or terminate Your access to the Service if You breach these Terms, fail to pay applicable fees, or use the Service in a way that risks harm to Us, other users, or third parties. You may stop using the Service and close Your Account at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.
Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, We disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet Your requirements or be uninterrupted, secure, or error-free.
Limitation of Liability
To the fullest extent permitted by law, We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or in connection with the Service. Our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the amounts You paid Us for the Service in the twelve (12) months preceding the event giving rise to the claim.
Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Where changes are material, We will provide reasonable notice. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
Governing Law and Disputes
These Terms are governed by the laws of Poland. Any disputes arising out of or in connection with these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Warsaw, Poland.
